Terms of Service
These terms are an agreement between you and Atlas Terminal ("we", "us") for the Atlas Terminal website, accounts, and desktop app (together, "Atlas Terminal"). By creating an account, joining the beta, or installing or using the app, you agree to them. If you use Atlas Terminal for an organization, you agree on its behalf and confirm you have authority to do so. Our Privacy Policy explains how we handle personal information.
1. Who can use Atlas Terminal
You must be at least 13 years old, or older if your country requires it. If you are under 18, you need a parent's or guardian's permission, and they accept these terms for you.
2. Your account
Give us accurate information and keep it up to date. Keep your password secure and do not share your account. You are responsible for what happens under your account. Tell us promptly at privacy@atlasnetworks.tech if you think someone has used it without permission.
3. Private beta and pre-release software
Atlas Terminal is in development. Beta and pre-release versions may contain bugs, change or lose features, or be unavailable at times, and we may end the beta. Keep your own backups of anything important. If you send us feedback, we may use it to improve Atlas Terminal without any obligation to you.
4. Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own or your organization's internal purposes, in line with your plan:
- Free: any number of devices, each with its own device-bound license.
- Pro: the Pro features on up to 8 active devices at a time. You can release a device from your account to license another.
Licenses are bound to a device and renew online to stay current. You must not share, sell, or transfer licenses; circumvent, disable, or tamper with licensing or device limits; or copy, modify, decompile, or reverse engineer the app, except as the law allows despite this restriction. The app includes open-source components that are licensed under their own terms, which take precedence for those components.
5. Plans, billing, and cancellation
Pro is a subscription billed in advance each month through Polar, our merchant of record. Polar's terms apply to your payment, and prices may include taxes. Your subscription renews automatically until you cancel. You can cancel at any time from your account; you keep Pro until the end of the period you have paid for, and we do not charge you again. We will give you reasonable notice before changing prices, and the change applies from your next billing period. Refunds are available where required by law, including the Australian Consumer Law, or as Polar's refund policy allows.
6. Acceptable use
Atlas Terminal includes powerful network and remote access tools. You must use them lawfully and only on systems, networks, and devices you own or are authorized to access and test. You must not:
- access, scan, probe, or attack any system without authorization, or use Atlas Terminal to break the law, including computer offence laws such as Part 10.7 of the Criminal Code Act 1995 (Cth);
- distribute malware, send spam, or harm, harass, or defraud anyone;
- attack, overload, scrape, or try to gain unauthorized access to our website, servers, or other users' accounts;
- use automated means to create accounts or guess passwords;
- infringe anyone's intellectual property or privacy.
7. Your content
Your connections, credentials, scripts, files, and terminal sessions belong to you and stay on your device, except where you choose to send them to a third-party service such as an AI provider or cloud storage. You are responsible for your content and for keeping backups. Where you give us content, such as support requests, you allow us to use it only to provide and improve Atlas Terminal.
8. Third-party services and AI
Some features work with services you choose, such as AI providers, Dropbox, Google Drive, Google sign-in, and EVE-NG. Their own terms and privacy policies govern your use of them, and we are not responsible for them. AI output can be wrong, incomplete, or unsafe. Review AI suggestions and commands before you run them, especially on production systems.
9. Changes and availability
We may update, change, or stop features, and we may need to interrupt the service for maintenance. If we discontinue a paid feature you have paid for, we will give you reasonable notice and, where appropriate, a pro-rata refund.
10. Our intellectual property
Atlas Terminal, its software, design, and brand belong to us or our licensors. These terms do not give you any rights to them other than the license in section 4.
11. Suspension and termination
You can stop using Atlas Terminal and ask us to delete your account at any time. We may suspend or end your access, and revoke licenses, if you seriously or repeatedly breach these terms, if we must for legal reasons, or to protect others or the service. Where reasonable, we will tell you first and give you a chance to fix the problem. Sections 7, 10, 12, 13, 14, and 15 continue after termination.
12. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for failing to meet such a guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
13. Disclaimers and limitation of liability
Subject to section 12 and to the extent the law allows, Atlas Terminal is provided "as is" and "as available", without other warranties, and we are not liable for any indirect or consequential loss, or for loss of data, profits, revenue, or business, arising from your use of Atlas Terminal. Subject to section 12, our total liability to you under or in connection with these terms is limited to the amount you paid us in the 12 months before the claim arose, or AUD 100 if you have not paid us. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited by law.
14. Your responsibility to us
To the extent the law allows, you agree to compensate us for loss we suffer because of a claim by a third party arising from your breach of section 6, except to the extent we caused or contributed to the loss.
15. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of the country where you live.
16. Changes to these terms and general
We may update these terms. If a change is significant, we will tell you by email or with a notice on the site at least 14 days before it takes effect; if you do not agree, you can stop using Atlas Terminal and cancel your subscription. If any part of these terms is unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. These terms and the Privacy Policy are the entire agreement between you and us about Atlas Terminal.
